Recent enforcement actions highlight the need for an effective and updated compliance plan.
A doctor in Arkansas has been sentenced to 102 months in prison and paid more than $4.63 million in damages. Upon release from prison, he will undergo supervised release for three (3) years. He was also fined $2,200 for special assessment.
The doctor was found guilty of signing prescriptions for patients he did not know or treat.
The doctor was later found guilty of lying about his actions to the FBI. He claims he only signs prescriptions for those he evaluates and denies taking bribes.
In response to a subpoena, he turned over only a small portion of the records. He also falsified medical records.
The Arkansas doctor’s action serves as a sobering reminder that it’s important to stick to your adherence plan. Once the bad conduct is discovered, it is necessary to follow your compliance plan to correct and address any issues.
Your practice should have an overall compliance plan and an action plan if you notice a problem.
Your staff should also be trained on how to respond in the event of an investigation.
